Law 794: Clean Air Act

This course will provide an in-depth study of the federal Clean Air Act from a practitioner's perspective, examining rulemaking, compliance/enforcement actions and appellate litigation under the Act. The course will examine the overall statutory scheme of the Act and how it works to protect public health, focusing on the last major Congressional amendments in 1990 and how they have been implemented on state and federal levels; how formal rulemakings, case law, agency practices and federal guidance inform and affect the practice of law under the Act; and, the unique form of federalism established under the Act and how it operates. The course will also examine how the practice of law operates to resolve complex legal issues within a framework also requiring the resolution of complex scientific and public policy issues.
